Voluntary Protocols of Bredevoort, 1614

Friday, 20 May 1614 – Stadtholder Joannes ter Woert, assessors Peter Cloeck and Henrick Menekinck.

Appeared Johan Boeinck for himself and also on behalf of his mother Floerken Floriss, widow of the late Johan Boeinck, and all her other children, for whose ratification and approval he stood sure, and on behalf of all their heirs. He acknowledged for himself, his mother, the aforesaid brothers and sisters and their heirs that, for goods previously bought and received by his mother, they owed Johan van Joeckeren and Enneken Spormekerinck, spouses, the sum of 317 dalers in Bocholt currency, each daler reckoned at thirty stuivers and each stuiver at twenty-one hellers. This was in accordance with an acknowledgement issued under their hand eight days after St Nicholas Market in 1611. For this sum and the proper interest accruing from this date, he, on behalf of himself, his mother, brothers and sisters and their heirs, mortgaged and pledged to Johan van Joeckeren, his wife and heirs, in the strongest legal form, the hereditary estate and farm de Hoge Ungenade with all its appurtenances and rights, situated in the hamlet of Heurne in the parish of Aalten. The aforesaid principal and any interest due for delay could be recovered from it. He promised warranty, undertook to obtain the further approval of his mother, brothers and sisters, and to provide a better deed and confirmation according to local law. It was noted that all interest due up to this date was included in the stated sum. All without deceit.

Wednesday, 20 July 1614 – Drost and Judge Gosswin van Lawick, assessors Johan ter Woert and Derick
Wedlinck.

Appeared Floerken Floriss, widow of Johan Boenck, together with the aforesaid Derick Weddelinck, chosen and admitted as her guardian in this matter. She acknowledged for herself and her heirs that, for a fully paid sum of money, she had in the strongest legal form transferred and sold in pledge, together with peaceful possession, use and enjoyment, to Johan van Joeckeren, citizen of the town of Bocholt, his wife Enneken Spormeckerinck and their heirs, her hereditary estate and farm Hoge Ungenade situated in the hamlet of Heurne in the parish of Aalten, with all its appurtenances and rights, as an entirely unencumbered pledged property, free of tithes, dues, debts and the like. She ceded and surrendered it, renouncing it by hand and word, and promised warranty, a better deed and confirmation according to local law. She reserved the right of redemption, to be announced one quarter of a year in advance and thereafter exercised annually on the feast of Saints Philip and James, within fourteen days before or after, by payment of 350 dalers in Bocholt currency, each daler reckoned at thirty stuivers and each stuiver at twenty-one hellers. Thursday, 3 November 1614 – Drost and Judge Gosswin van Lawick, assessors Johan ten Berge and Peter Cloeck.

Appeared Floorken Floriss, widow of the late Jan Boenck, together with Johan ten Berg, chosen and admitted as her guardian in this matter. Acting under the aforesaid guardian’s authority for herself, her children and heirs, she acknowledged that under an obligation dated 10 July 1611 she owed Fijken Scheffers the sum of 240 dalers in Bocholt currency and had provided no specific security for it. Therefore, for herself and as guardian of her children, and for them and their heirs, she now pledged to Fijken and her heirs, as special security for the aforesaid sum and the interest falling due on it, three moldersaet of land on the Hogen Ongenade next to Kortbeck and adjoining land belonging to Fijken. In the event of non-payment, the aforesaid principal and interest, together with costs and damages, could be recovered from this land by distraint according to local law. The other points and clauses of the obligation remained unchanged. Without exception or deceit.
